These are the standard terms of business (“Terms”) of Kankoor Education (“Kankoor Education”, “we”, “us”, the “Company”) and the term ‘you’ refers to the person using or visiting the Kankoor Education website.

Introduction to our Code of Practice as well as the Use of Kankooe Educations’ Website

When using our website, you automatically accept and are bound by the Kankoor Educations’ Code of Practice. You should not use our website should you disagree with our Code of Practice in anyway. The intellectual property rights and material on the Kankoor Educations’ website is wholly owned by us unless otherwise stated. All rights are reserved. The terms that follow dictate the use of this website: Kankoor Education does not provide any guarantee that the content on this website is accurate. Nor does Kankoor Education offer any warranty about the suitability of the content shown on this website or any documents produced by Kankoor Education. The user of the website is fully aware that the information provided by Kankoor Education might be inconsistent and also that Kankoor Education openly exclude liability for any mistakes to the fullest extent permitted. It is up to you, the user, to be sure that anything available (products, services and information) through the Kankoor Education website is specific to their requirements. Kankoor Education accepts no responsibility if what is offered does not meet expectations. The content on any part of the Kankoor Educations’ website is, without any notice, subject to change. All material on the Kankoor Educations’ website is owned by us and may not be reproduced. Written consent from Kankoor Education is needed to create links between this website and another website. Any other website links that are seen on the website are for your use but this does not mean to say that Kankoor Education wholly agrees with the content of these websites nor does Kankoor Education accept the content published on these linked websites. If any dispute arises when you use this website then this will be subject to the laws of England, Scotland and Wales.

Information we collect from you

We will collect and process the following data about you: Information you give us; this is information about you that you give us by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use our site, subscribe to our service, place an order on our site, participate in discussion boards or other social media functions on our site, enter a competition, promotion or survey, contact customer support through chat and when you report a problem with our site. The information you give us may include among others your name, address, e-mail address and phone number, financial and credit card information, personal description and photograph, family data, information about your children’s educational status, their grades, school attendance records, school reports, teacher interviews and more as well as information on your preferred currency, your country, date of birth, bank name, bank account number, SWIFT and IBAN. Information we collect about you; with regard to each of your visits to our site we will automatically collect the following information: technical information, including the Internet protocol address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform and currencies. information about your visit, including the full uniform resource locators, clickstream to, through and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, detailed information about usage of the system like web sessions, OS, mobile device, marketing metrics and events and any phone number used to call our customer service number. Information we receive from other sources. This is information we receive about you if you use any of the other websites we operate or the other services we provide. We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers (such as Google Analytics), search information providers, credit reference agencies). If necessary we will notify you when we receive information about you from them and the purposes for which we intend to use that information. We use Google Analytics (a web analysis service that utilizes the data collected to track and examine the use of our site, prepare reports on its activities and share them with other Google services), www.tutorcruncher.com and Stripe (a payment processing service processing payments by credit card, bank transfer or other means) which will have their own privacy policies.

Our website uses cookies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site. Uses made of the information we collect We use information held about you in the following ways: Information you give to us; we will use this information: to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us. to provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about. to provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you. If you are a new customer, and where we permit selected third parties to use your data, we (or they) will contact you by electronic means only if you have consented to this. If you do not want us to use your data in this way, or to pass your details onto third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data. to notify you about changes to our service. to ensure that content from our site is presented in the most effective manner for you and for your computer. Information we collect about you; we will use this information: to administer our site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes. to improve our site to ensure that content is presented in the most effective manner for you and for your computer. to allow you to participate in interactive features of our service, when you choose to do so. as part of our efforts to keep our site safe and secure. to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you. to make suggestions and recommendations to you and other users of our site about goods or services that may interest you or them. Information we receive from other sources. We will combine this information with information you give to us and information we collect about you. We will use this information and the combined information for the purposes set out above (depending on the types of information we receive). Note that Google may use the data collected to contextualize and personalize the ads of its own advertising network and that Stripe may enable the sending of timed messages to you, such as emails containing invoices or notifications concerning a payment.

Disclosure of your information

You agree that we have the right to share your personal information with: Selected third parties including: business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you; analytics and search engine providers that assist us in the improvement and optimisation of our site; payment and credit reference agencies for the purpose of payment process and assessing your credit score where this is a condition of us entering into a contract with you. We will disclose your personal information to third parties: In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets. If we or substantially all of our assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets. If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of service and other agreements; or to protect our rights, property, safety, customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who works for us or for one of our suppliers. This includes staff engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You can also exercise the right at any time by contacting us at support@kankooreducation.com. Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Access to information

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request will be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

Changes to our privacy policy

Any changes we make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates or changes to our privacy policy.

Tutors and Clients

Kankoor Education reserves the right to be able to change these Code of Practice whenever they so wish. These changes will be made known to clients and tutors in writing but changes can take place with immediate effect. This Code of Practice is the ultimate agreement when it comes to Kankoor Education, clients and tutors being involved. This means that no other Code of Practice or Terms of Engagement can be put forward and agreed to by any party unless Kankoor Education provides written consent. Kankoor Education also has to agree in writing to alterations of this Code of Practice should any changes be valid. By accepting to participate or use our services, clients and tutors are automatically showing agreement to this Code of Practice.

Clients

You acknowledge that our Service involves the facilitation of introductions between Customers and Tutors. You accept and agree therefore not to make arrangements with Tutors for the provision of educational services without reference or payment to Kankoor Education for the Service.

Fees and Payment

The tutor is never paid directly. Kankoor Education manages the payment of all tutors. Instead, the client will receive an invoice at the beginning of each month for the previous month’s tuition. The client must then make sure that Kankoor Education receives payment within ten days of the date of the invoice. This is done by Credit Card Auto Payment or Direct Debit unless the family is prepaying for lessons. The Client will agree the fee before any tutoring takes place. The tutor will submit an online time sheet to Kankoor Education for the work they have done with the tutee. Kankoor Education reserves the right to request the Client’s credit or debit card details. Any credit or debit card details that the Client supplies will be held securely and may be charged in the event of late or non-payment. As such, Kankoor Education reserves the right to take payment for invoices from any payment card we may hold from the Client. Any credit or debit card details that you supply will not be passed on to any third party.

Additional costs

The client must agree to any extra expenses with the tutor before any tuition takes place. This might be travel expenses and schoolbooks.

Liability

To the fullest extent possible allowable under the law, we exclude all liability to you directly or indirectly arising out of our Services. We cannot be held responsible for any actions of any Tutor or other third party introduced to you by us whether in the course of the Service or otherwise. We do not, however, seek to limit our liability in respect of any fraud or negligence in the delivery of the Service, nor for our liability for death or personal injury caused by our negligence, nor do we seek to limit our liability in any other way not permitted by law.

Non-solicitation

Under no circumstances can the client organise a private arrangement with the tutor that was introduced by Kankoor Education. In this event, the client should expect Kankoor Education to obtain an injunction against them to stop from this happening again. The client will also be liable to account to Kankoor Education for the entire amount paid to the Tutor with no reduction in anyway.

Tutors

The following is to be agreed by both the client and tutor: You acknowledge that our Service involves the facilitation of introductions between Customers and Tutors, when a tutoring session is confirmed. It is compulsory for you (the tutor) to sign a copy of Kankoor Educations’ Terms and Condition to confirm acceptance of these. Kankoor Education only accepts responsibility for matching up tutors that they think are suitable for the tutee in question and not for what happens when the tutoring sessions take place. Private Arrangements you are not allowed to make a private arrangement with a client introduced to you by Kankoor Education. In the event of this taking place, you will then be liable to paying Kankoor Education the amount paid to you by the client with no reduction. The tutor should then expect Kankoor Education to obtain an injunction against them to stop from this happening again. All work suggested to a tutor by a client of Kankoor Education has to be billed through Kankoor Education on your behalf, the arrangement of billing is to be carried out in the same manner as a norm introduction by Kankoor Education would be. It is possible though to request a commission to be arranged from Kankoor Education for new clients referred to you, the tutor, by our clients.

Payment

You cannot change the fee in anyway with the client unless you have written consent from Kankoor Education. Kankoor Education will agree the amount with both you and the client in advance of the first tutoring session. The clients will be invoiced by Kankoor Education on behalf of the tutors. The tutor must log their hours on our internal system on time each month, you will then be paid accordingly. It is up to the tutor to keep their hours logged up to date. This is so that there will be no problems if a client was to question hours as all will have been recorded and signed. The tutor is never paid directly by the client, Kankoor Education acts as the agent for the tutor. The tutor will receive payment from Kankoor Education (not the client) in the second half of each. If the tutor does accept direct payment from the client then this amount will be payable to Kankoor Education immediately and shall be actionable through the Courts straight away. Tutors agree, under this Agreement, that it is up to them to pay tax and national insurance contribution that they are due to pay when the payments made from Kankoor Education are concerned. For record keeping purposes, the tutor will account for the full fees paid by the client as income and the commission as expenditure.

Expenses

These (books and travel) must be agreed with the client prior to each tutoring session. Receipts for everything paid for by the tutor that he/she is planning to expense must be kept as proof, also this means that books can be returned should the client then not wish to buy them. No expenses that are not agreed with the client will be repaid to you.

Damages

No liability is accepted by Kankoor Education for any claims made by the client that relates to any tutoring sessions carried out by a tutor that they have introduced. The tutor also agrees to indemnify Kankoor Education without limit in respect of any of these claims.

Data Protection Act

The information gathered from and about tutors is solely used by Kankoor Education for the services that it provides. When tutors provide Kankoor Education with information, the tutors consent to Kankoor Education using this information to arrange introductions to clients as well as being able to contact them. Kankoor Education will also use this information for payment purposes too in terms of billing and fee collecting.

Confidentiality

The tutor is of the understanding that he or she must not at any time during this agreement, or for a period of three years after this agreement terminates, disclose to any person any confidential information that concerns the affairs, customers, clients, business or suppliers of Kankoor Education. The only exception being that you may disclose any of Kankoor Education’ confidential information if required to by law or any government or regulatory authority. None of Kankoor Education’ confidential information can be used for anything that does not directly help you to perform your obligation to this agreement.

Approval

Acceptance of our services will be taken to represent agreement to this Code of Practice.
